PHC Petition Challenges Emergency, Governor’s Rule in KP

A petition has been filed in the Peshawar High Court (PHC). It challenges the imposition of an emergency and governor’s rule in Khyber Pakhtunkhwa (KP).

Advocate Salman filed the petition. He named the President of Pakistan, the Prime Minister, and the KP Governor as respondents.

The petitioner argued that the measures violate the Constitution and the law. He also alleged mala fide intentions behind the decision.

According to the petition, the measures violate fundamental rights. They also undermine the democratic mandate of the people of KP.

The petitioner asked the high court to declare the emergency and governor’s rule unlawful. He also requested that the court declare both measures unconstitutional and null and void.

In addition, he sought the suspension of the governor’s rule notification. He wants the suspension to remain in place until the court delivers its final decision.

The available report does not confirm whether the court has heard the petition. It also does not mention any interim order.
